These terms cover your use of this website. They are an agreement between you and Curb & Canopy Landscape Co., a landscape design studio based in Illinois. Please read them. They are short.

Accepting these terms

By using this website, you agree to these terms. If you do not agree, please do not use the site.

What this site is

This site is informational and marketing material. It describes what we do, shows examples of our work, and gives you a way to contact us. Using the site does not hire us and does not create a client relationship.

Design work is governed by a separate agreement

We sell landscape design. A design costs $895 and includes concept renderings, a planting plan, and an itemized install estimate. When you hire us, the proposal or agreement you sign is what governs that work: scope, revisions, timing, payment, and everything else. These terms of use cover the website only. If the two ever conflict about your project, your signed agreement controls.

Nothing here is professional advice

Content on this site is general information. It is not landscape design advice, horticultural advice, engineering advice, or legal advice for your property. Do not rely on it for decisions about your site, your permits, or your plants. Local rules, utilities, drainage, easements, and soil conditions vary, and they need to be checked for your specific address. We give property specific recommendations only through a signed design engagement.

Renderings are illustrative

The renderings on this site and in our design deliverables are artistic concepts. We create them with AI assistance and human judgment, and their purpose is to show the intent of a design: the shapes, the massing, the feel of the yard.

They are illustrations, not predictions or guarantees. Real plants differ from painted ones. Plants grow at their own pace, look different in each season, and respond to sun, soil, water, deer, and weather. Installed work will not match a rendering pixel for pixel, and it is not meant to. Plant names and quantities in the planting plan are the specification. The image is the mood.

Installer referrals

We design. We do not install. Typical third party installation for our designs runs about $3,500 to $10,000, and we are glad to introduce you to independent installers we know.

A referral is an introduction, nothing more. Those installers are separate businesses. We do not employ them, supervise them, control their pricing or schedule, or warrant their work. Your contract for installation is with them. Please get your own written bid, check licensing and insurance, and ask the questions you would ask any contractor. If something goes wrong on an install, we want to hear about it, but the installer is responsible for their own work.

Our content and our name

The text, images, renderings, plans, layout, and design of this site belong to Curb & Canopy Landscape Co. or to the people who licensed them to us. The Curb & Canopy name and logo are our marks.

You may view the site, and print or save pages for your own personal, non commercial use. That is the only license we grant. Please do not copy, republish, sell, or build derivative works from our content, and please do not use our name, logo, or renderings to promote anything, without our written permission. Design deliverables you buy from us come with whatever use rights your signed agreement gives you.

Acceptable use

Use the site normally and in good faith. Please do not:

• Scrape, crawl, harvest, or bulk download the site or its images by automated means, except for ordinary search engine indexing.
• Probe, scan, overload, or interfere with the site, its servers, or its security.
• Submit false contact information, or someone else's address without their permission.
• Send us anything unlawful, abusive, or infected with malicious code.
• Use the site for any unlawful purpose or in violation of any law that applies to you.

We can suspend access to the site, or to our contact form, if it is being misused.

Third party services and links

This site runs on Cloudflare and uses Google services for address suggestions and typefaces. It may also link to other websites. Those companies and sites are not under our control. We are not responsible for their content, their availability, or their practices, and a link is not an endorsement. Their own terms and privacy policies apply when you use them. What each service receives is described in our privacy policy.

Disclaimer of warranties

The website is provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the site will be uninterrupted, timely, secure, or error free, or that the information on it is complete, accurate, or current. Some states do not allow certain warranty exclusions, so parts of this paragraph may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of this website. Our total liability for any claim relating to this website will not exceed the total amount you have paid us through this website. We do not take payments on this website, so that amount is $0. This limit applies to website use only. Liability for paid design work is addressed in your signed agreement. Nothing in these terms limits liability that cannot be limited under Illinois law, including liability for fraud, or for death or personal injury caused by negligence. Some states do not allow these limits, so parts of this paragraph may not apply to you.

Indemnification

If you misuse the site, or use it in a way that breaks these terms or the law, and that causes a claim against us, you agree to cover our reasonable costs and losses from that claim. This applies only to your own conduct, and we will tell you promptly if such a claim comes up.

Governing law and where disputes are heard

These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Any dispute about this website will be brought in the state or federal courts located in Lake County or Cook County, Illinois, and you and we agree to the jurisdiction of those courts. Before filing anything, please contact us. Most problems are easier to fix by phone.

Severability

If any part of these terms is found unenforceable, that part is limited or removed to the smallest extent needed, and the rest stays in effect. If we do not enforce a term right away, we do not give up the right to enforce it later.

Changes to these terms

We may update these terms. When we do, we will post the new version here and change the effective date at the top. Continuing to use the site after a change means you accept the updated terms.
